MINUTES OF DECEMBER 12, 2002

 

                The Schwenksville Borough Council Meeting of December 12, 2002 was called to order by Council President, H. Gilbert Williams at 7:30 p.m.

 

                ROLL CALL:  Secretary, Nancy Eppley

 

                Present:  H. Gilbert Williams, Gene Frantz, Donald A. Whitko, Raymond Yeanish.

                Absent:  Barbara Slater, Carroll Rosenberger

               

                MINUTES:

 

                Dispense with the reading of the Minutes of November 14, 2002: 

                MOTIONED BY DONALD A. WHITKO AND SECONDED BY RAYMOND YEANISH IT WAS VOTED TO DISPENSE WITH THE READING OF THE MINUTES OF NOVEMBER 14, 2002.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

                Approval of the Minutes of November 14, 2002:

                MOTIONED BY RAYMOND YEANISH AND SECONDED BY DONALD A. WHITKO IT WAS VOTED TO APPROVE THE MINUTES OF NOVEMBER 14, 2002.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

                ACCOUNTS PAYABLE/TREASURER'S REPORT:  Nancy Eppley

 

                Distributed for Councils' review and approval:  DEPOSIT REPORT:  Month of November, EXPENDITURES for tonight's meeting, REVENUE/EXPENDITURE REPORT from January 1 to December 14, 2002.  Also, a Treasurer's Report for the Month of November. 

 

                MOTIONED BY GENE FRANTZ AND SECONDED BY RAYMOND YEANISH IT WAS VOTED TO ACCEPT THE ACCOUNTS PAYABLE AND TREASURER'S REPORT AS SUBMITTED.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

                ENGINEER'S REPORT:  Kenneth Yerger

 

                -Mine Hill Road Roadway and Drainage Improvements:  Bid was awarded for the improvements and we are awaiting the submission of contract documentation.

 

                -Third Street Roadway and Drainage Improvements:  Project nearing completion.  Borough is inspecting the project with Carroll Engn. Consultation as needed.

 

                -Perkiomen Valley Elementary School:  Inspecting site improvements as required.

 

                SOLICITOR'S REPORT:  Loren Szczesny

               

                -Perkiomen Avenue:  PennDot  would like the Borough to take over the plowing of Perkiomen Avenue.  PennDot would reimburse the Borough.  By the Borough doing this it would benefit the borough residents.  It would also give better access to the residents of 2nd, 3rd, and 4th Streets.  It would be a 5 year contract, but solicitor will investigated, and the feeling is that the contract can be cancel at the end of a year.

                -Liberty Ministries:  A cease and desist notice to be issued for the Liberty Ministries property.  This notice is related to the use of the subject property and the program by individual's other than those released directly from a correctional facility.  The property owner has a right to Appeal to the Zoning Hearing Board.

 

                -Anna McKim Property:  A notice has been sent advising that the property is unsafe and to contact the Borough.  If no action is taken by the McKim relatives the Borough may have no other alternative but to proceed with the condemnation and demolition of the structure.  A lien would then be placed on the property for the costs incurred to accomplish the same.

 

                -Revitalization:  An agreement has been prepared between the Borough and Perkiomen Valley Economic Development Corporation which outlines the intention of the parties with respect to funding obtained from the County and appropriate use of the same.  Comments to be reviewed.

 

                POLICE REPORT:  Chief Timothy Hoppes

 

                Presented for councils' review the Monthly Report for November.

 

                State Police Responses:  18      Local Police Responses:  32

 

                -Addressed the Parking/Pedestrian at Jerusalem Lutheran Church Day Care:  Day Care Office has issued a letter to the parents of children requesting that the children cross at a designated area and that parking  be limited in the right direction.

 

                -Spoke on Credit Card  Fraud:  Be very careful about receiving pre-approved credit cards in the mail.  Destroy them if not intending to use them.  Also, suggested getting a credit report and making sure there are no charges that do not belong.  Told of one incident, that was very costly and was discovered in time.

 

                BOROUGH MANAGER:  Thomas Snyder

 

                -Main Street:  Meeting this afternoon.  Patching should be done by December 17th.

                  Pipes under the street belong to the Borough.

                  Borough will fix markings on the street.

                  Ray is concerned with the "ripples" in the road.

                 Milling will be at PECO's cost.

                 Every detail is not settled yet.

                 Concrete across the road is PennDot's responsibility.

 

               -Second Street:  Verizon has put in the cable for the school.  Taking longer than expected due to engineer for the School District..

               Problem on Second Street with a center line where the sidewalk will be-goes into Perkiomen Township.

 

                -Third Street/Perkiomen Avenue:  Cables need to go in, probably won't be until Spring.  Poles are in.

 

                -700 Main Street (former Leonard Gibeon property).  Real Estate Transfer came into the office and it was noted that the property was sold without obtaining Use and Occupancy Permita..

 

                -Maple Avenue:  Lack of crown, it is a surface problem.

 

                -Mountain View Avenue:  There is an inlet problem down at the corner.  Contractor needs to seal it.

TRAIL/REVITALIZATION:  Gilbert Williams

 

Going through surveys.  No regional plan map as yet.

 

PROPERTY:  Donald A.Whitko

 

-School Property:  Everything on schedule

 

-Main Sewer Lines behind buildings on the trail.  Concerned with the amount of dumping.  Lines are 15-20 feet below earth.  What if a problem occurs.  Council members didn't feel that there would be a problem should one occur.  It is only backfill, not shale.

 

FIRE COMPANY:  Gene Frantz     No report

 

STREET LIGHTING:  Raymond Yeanish

 

-Nothing to report.

 

-Christmas Lights are up.  They were put up by the Fire Company.  Good Job.

 

-Tom Snyder mentioned that the lights on Fourth Street were not put up properly.  One did come loose and fell.  PECO will be coming out soon.  Tom was told to get them out quickly.

 

MAYOR'S REPORT:  Carroll Rosenberger     Absent

 

OLD BUSINESS:  Nothing

 

NEW BUSINESS:  Trash Problems

 

A lot of problems with Waste Management.  Trash is not picked up in many cases.  Sometimes trash is left on parking lots after it has been dumped by the trucks.  Tom and Nancy have tried several times to set up an appointment to address these problems and billing errors with no avail.  Tom has called WM and told them that the checks are going to be held up until we the borough get some action.  Legally, can we do this?  Tom and Nancy will check.

 

AUDIENCE: 

 

Roy Miller:  Concerns of the Park:  Kids are misbehaving again.  Looks like a "war zone".  What is council going to do about the park?  Patrolling?  Tim had a conversation with the Park Superintendent a few park rangers along with Tim will keep an eye on things at the park.   Also, there are a lot of leaves at the park.  Ray mentioned that he has concerns about parks-the Authority has enough work to do.  Mentioned that perhaps a part-time maintenance man would be the answer. Gib mentioned that the Park Board should come up with some answers.  Roy mentioned that the trees are a problem also. 

 

Josephine Gill:  Christmas Lights look good.  Fire Company doing a good job in all areas.  Gib mentioned that there was a small problem at his "Carriage House", Fire Company did a good job.

MOTIONED BY  RAYMOND YEANISH AND SECONDED BY GENE FRANTZ IT WAS VOTED TO ADVERTISE THE 2003 BOROUGH BUDGET.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

December 30, 2002 at 7:30 p.m.  the Borough will hold a Special Meeting to adopt the proposed budget.  Other business will also be before council if need be.

 

All business having been completed, the meeting was adjourned.

                The Schwenksville Borough Council Special Meeting was called to order by Council President, H. Gilbert Williams at 7:30 p.m.

 

                Secretary, Nancy Eppley called the roll.  Present were:  H. Gilbert Williams, Barbara Slater, Donald A. Whitko, Gene Frantz, Raymond Yeanish and Mayor Carroll Rosenberger.

 

                PLEDGE OF ALLEGIANCE:  By the assembly

 

                POLICE CHIEF'S BUDGET/CONTRACT:  Committee met and approved.

MOTIONED BY GENE FRANTZ AND SECONDED BY DONALD A. WHITKO IT WAS VOTED TO APPROVE THE POLICE CHIEF'S BUDGET/CONTRACT.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

                RE-APPROVING MEADOW PARK SUBDIVISION PLAN.

MOTIONED BY RAYMOND YEANISH AND SECONDED BY GENE FRANTZ IT WAS VOTED TO REAPPROVE THE MEADOW PARK SUBDIVISION PLAN.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

                AUTHORIZING THE ADVERTISING FOR THE SUBDIVISION STORM WATER MANAGEMENT ORDINANCE.

MOTIONED BY DONALD A. WHITKO AND SECONDED BY GENE FRANTZ IT WAS VOTED TO HAVE ROBERT BRANT'S OFFICE ADVERTISE THE SUBDIVISION STORM WATER MANAGEMENT ORDINANCE.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

Ray questioned the events in this project.  Tom Snyder will make copies of this proposed ordinance and give council copies.  This ordinance will fit the borough's needs.  Planning Commission will review again.

 

                ADOPT 2003 PROPOSED BUDGET AS POSTED

MOTIONED BY RAYMOND YEANISH AND SECONDED DONALD A. WHITKO IT WAS VOTED TO ADOPT THE 2003 PROPOSED BUDGET AS PRESENTED.  ALL WERE IN FAVOR AND THE MOTION CARRIED.

 

Other Business:

 

Planning Commission Letter dated 12/29/02

 

Planning Commission passed the proposed ordinance to amend Ordinance #268 by adding section 428-Stormwater Management.  Also, proposed to change the meeting night from the third Thursday of the month to the first Thursday of the month and have the council meeting changed from the seconded Thursday to the third Thursday of the month.  This would allow business brought before Planning to also be enacted by council in the same month.

 

This suggestion needs to be discussed and see how schedules work with everyone involved.  At the present time, everything will stay the same.

 

Joy Lamison-Borough Auditor has contacted Carroll and feels that she cannot serve at this time as an Auditor.  Nancy will write or call and request a formal resignation.

Mine Hill Road:  Termination of Job

 

Letter will be going out by Loren Szczesny that the Borough is terminating the job for the present time. A notice of an award has been given but no notice to proceed.  Any grant monies will be sent back to the "pool".  Borough wishes to be solvent before going ahead with any major projects.
